    We can assist with registering trusts and also amending existing trusts for clients. A trust is a legal arrangement whereby a third party holds property and assets for the benefit of one (or more) people. Trusts are governed by the Trust Property Control Act 1988.

    The primary statute that governs South African trust law is the Trust Property Control Act of 1988, which regulates certain administrative aspects relating to trusts.

    Furthermore, South African trusts are also governed by the Administration of Estates Act, which regulates the disposal of the deceased’s estates in South Africa; The Wills Act, which affects all testators with moveable/immovable assets in South Africa; The Intestate Succession Act, which governs the devolution of estates for all deceased persons who have assets in the Republic and who die without a will; the Income Tax Act and common law.
